I am not familiar with how this controller does things, but assuming what you say is correct, you should not have to do anything.
A midi note-on is a tuple of key (note) and velocity. If, as you say, the controller limits the output velocity of note-ons generated for some pads (hihat) when said pedal is held, then that should be it. Assuming you've mapped the samples with proper velocity mapping (default), all should be dandy.
Btw: this is not nor has anything to do with Midi CC if it is as you describe; Midi CC (control change or continous controller) are messages conveying attributes changing over time, such as pressure or intonations, though of course mostly they are just mapped to sliders on your controller keyboard.![Smile :-)]()
